INFORMATION REGARDING THE PROTECTION OF PERSONAL DATA IN ACCORDANCE WITH THE EUROPEAN REGULATION (EU) 2016/679 AND AS NEWS BY THE LEGISLATIVE DECREE. 101/2018

6. Methods and purposes of processing

The processing of Personal Data will take place using manual or electronic methods suitable to guarantee, in relation to the purposes for which they were communicated and collected, their security and confidentiality, as well as to avoid unauthorized access to the data themselves, for the time strictly necessary to achieve the purposes for which they were collected.

Apart from what is specified for cookies, the Personal Data provided by users are processed for the following purposes:

a. Manage the applications freely sent by interested parties to fill a job position, in the "Work with us" form; 

b. Sending marketing material by LIGUORI concerning products, services, offers or events, general or personalized, based on my choices and interests indicated or assumed, via the contact means mentioned above, "Newsletter”.

This purpose requires your explicit consent (art.6.1, letter a, GDPR), without which you will not be able to receive the requested service.

- sending advertising material (examples of activities are: sending advertising material on new services to your e-mail; the legal basis of this purpose is identified in the acquisition of your consent to the processing of personal data for a purpose (art.6.1, letter a, GDPR);

- activities connected to the execution of the contract of which you are a party, including the pre-contractual phase (examples of activities are: the provision of a service: Participation in Events; the legal basis of the aforementioned purpose is identified in the contract and pre-contractual measures ( art. 6.1, letter b, GDPR), but also (where appropriate) in the legitimate interest (art. 6.1, letter f, RGDP) as regards the need to defend a right and as well as in the fulfillment of a legal obligation or regulations in force or to fulfill an obligation imposed by the Authorities (art. 6.1, letter c, GDPR);

- maintenance of IT systems and devices (the parties in charge of carrying out maintenance and repairs on the Site may accidentally have access to your personal data. These are entirely occasional and unpredictable events and in any case have no identification purpose and are of limited duration to execution of the maintenance/repair operation); the legal basis of the aforementioned purpose is identified in legitimate interest (art. 6.1, letter f, GDPR).

8. Categories of subjects who may process personal data (Recipients)

LIGUORI undertakes to ensure that the Personal Data of which it becomes aware will be processed in ways suitable to guarantee its security and confidentiality, as well as to avoid unauthorized access to the data itself. The personal data and information provided by users through registration on the page may be communicated, for the above purposes, to the following categories of subjects:

1. LIGUORI employees, who will process the data as appointed persons;

2. the agency that manages the maintenance of this Website on behalf of LIGUORI, namely Epsilon Srl with registered office in Via Carlo Poerio 89/A – 80121 Napoli as Data Processor (art.28 - GDPR; the agency that manages the maintenance of this Website on behalf of LIGUORI, namely ALF Srl with registered office in Via Luigi Einaudi 7, 12051 Alba (CN) as Data Processor (art.28 - GDPR);

3. the public authorities competent to carry out the checks required by law (e.g. ministries, notaries or protection officers, chambers of commerce, police forces and others).

9. Transfer of your personal data abroad

We share your Personal Data with the named entities, who may be located in Switzerland or other countries within or outside the European Economic Area (EEA), including in countries whose laws may not provide the same level of protection as data expected in the EEA or Switzerland. We guarantee that various security measures are in place, appropriate to protect your Personal Data in accordance with our legal obligations and that the recipient will only process your Personal Data in accordance with our instructions. Where necessary, we use data transmission agreements with recipients, which are based on the standard contractual clauses approved by the European Commission (in Article 46 (2) of the General Data Protection Regulation) and/or the Federal Data Protection Act and the Swiss Transparency Officer.

It should be noted that the European Commission announced, at the beginning of August 2023, that it had officially approved the "EU-US Data Privacy Framework" (“DPF”), i.e. the new agreement for the transfer of data from the EU to the USA. The new adequacy decision was published on 10 July 2023 and with it the European Union formally recognized that the United States guarantees an adequate level of protection of personal data, comparable to that of the EU.

When LIGUORI uses a service provider located outside the EEA, personal data is transferred from the European Union to the United States for processing purposes only, a contract will be concluded, regardless of the participation of the data controller in the EU . The US Privacy Framework (EU-US DPF) and, as applicable, the UK extension to the EU-US DPF and/or the Swiss-US Data Privacy Framework (Swiss-US DPF).

Data Controllers in the European Union/European Economic Area and, as applicable, the United Kingdom (and Gibraltar) and/or Switzerland are always required to enter into a contract when a transfer is made solely for the purposes of processing , regardless of whether the processing operation is carried out within or outside the European Union and, as the case may be, the United Kingdom (and Gibraltar) and/or Switzerland, and whether the controller participates or not to the EU-US DPF and, as the case may be, to the UK Extension to the EU-US DPF and/or Swiss-US DPF. The purpose of the contract is to ensure that the data controller:
